A few words about the Availability of Records:

Please be advised that although we make every attempt to service records the same day you request them, there may be times we are unable to process due to preservation or format issues.  If you are requesting audio or digital files please make arrangements prior to your visit.

The Delaware Freedom of Information Act (Delaware Code Title 29 chapter 100§10002 (l)) restricts the access of certain public records. The following records are exempt under FOIA: educational, medical, criminal, personnel, and building or structural plans. Furthermore, FOIA does not apply to the records of the General Assembly or to the courts. This access policy applies to state and local government records both in paper and electronic form. Also, there is currently in effect a security procedure that relates to our holdings of architectural drawings. Before one can view or request copies of these records, they must send a request in writing stating the need for these records to the attention of our State Archivist, Stephen M. Marz, Delaware Public Archives, 121 Martin Luther King Jr. Blvd. North, Dover, DE 19901. A notarized photocopy of a government issued photo ID (such as a driver’s license) must accompany the letter. You will then be notified about the availability of the records for which you have inquired.
